1. Acceptance of Terms

By accessing or using OpenQuiz ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

2. Account Registration and Security

2.1 Account Creation

To use certain features of OpenQuiz, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

2.2 Account Eligibility

You must be at least 13 years old to use OpenQuiz. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Use of the Service

3.1 Permitted Use

You may use OpenQuiz to:

• Create, host, and participate in interactive quizzes
• Share quiz content with others
• View quiz results and analytics
• Use features available in your subscription plan

3.2 Prohibited Activities

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Violate or infringe upon the rights of others, including intellectual property rights
• Upload, post, or transmit any content that is harmful, offensive, defamatory, or violates any person's privacy
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated systems (bots, scrapers) to access the Service without permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Collect or harvest information about other users without their consent
• Use the Service to send spam, chain letters, or unsolicited communications
• Create quizzes containing malicious content, malware, or phishing attempts

4. User Content and Intellectual Property

4.1 Your Content

You retain ownership of all content you create, upload, or post on OpenQuiz ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Use, reproduce, and display your User Content on the Service
• Modify and adapt your User Content as necessary to provide the Service
• Distribute your User Content to other users as part of the Service

4.2 Our Intellectual Property

The Service, including its original content, features, and functionality, is owned by OpenQuiz and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.

4.3 Content Responsibility

You are solely responsible for your User Content. We do not endorse or assume any responsibility for User Content. We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable.

5. Subscription and Payment Terms

5.1 Subscription Plans

OpenQuiz offers both free and paid subscription plans. Paid plans are billed on a recurring basis (monthly or annually) as selected during checkout.

5.2 Payment Processing

Payments are processed through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's terms and conditions. We do not store your full payment card information.

5.3 Billing and Renewal

• Subscriptions automatically renew at the end of each billing period
• You will be charged the subscription fee on the renewal date
• You can cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods

5.4 Price Changes

We reserve the right to modify subscription prices. Price changes will be communicated to you at least 30 days in advance. Continued use of the Service after a price change constitutes acceptance of the new price.

6. Service Availability and Modifications

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted or error-free operation. We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time
• Perform scheduled or emergency maintenance
• Update features, functionality, or user interface
• Impose usage limits or restrictions

We will make reasonable efforts to notify users of significant changes or service interruptions.

7. Disclaimers and Limitation of Liability

7.1 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPENQUIZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless OpenQuiz, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any User Content you submit, post, or transmit through the Service

9. Termination

9.1 Termination by You

You may terminate your account at any time by deleting your account through the account settings or by contacting us. Upon termination, your right to use the Service will immediately cease.

9.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you:

• Violate these Terms of Service
• Engage in fraudulent, illegal, or harmful activities
• Fail to pay subscription fees when due
• Use the Service in a manner that disrupts or harms the Service or other users

9.3 Effect of Termination

Upon termination, your access to the Service will be revoked, and we may delete your account and User Content. We are not obligated to retain your data after termination, except as required by law.

10. Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which OpenQuiz operates, without regard to its conflict of law provisions.

10.2 Dispute Resolution Process

If you have a dispute with OpenQuiz, you agree to first contact us to seek an informal resolution. If we cannot resolve the dispute informally, you agree to resolve the dispute through binding arbitration or small claims court, as applicable.

11. General Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OpenQuiz regarding the Service.

11.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

11.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

11.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms or any rights hereunder without your consent.

11.5 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
